1. Acceptance of terms
By creating an account or otherwise using Datim-QI, you agree to these Terms of Use. If you do not agree, you must stop using the service. These Terms apply alongside the Disclaimer, Privacy Policy and Cookie Policy. If there is a conflict between documents, the Disclaimer takes precedence on matters of clinical/professional reliance.
2. Nature of the service
Datim-QI is a benchmarking and quality-improvement tool for NHS general practice. It compares published QOF, prescribing and clinical-audit data across national, ICB, PCN and peer groups, and offers an optional AI-generated quality-improvement plan drawn from that comparison. It uses organisation-level aggregate data only and is not a medical device: it does not analyse an individual patient, diagnose, prescribe or select treatment. It does not provide clinical, legal or financial advice, and using it does not create a professional relationship or duty of care; see the Disclaimer for full detail.
3. Accounts
You must provide accurate information when registering (name, professional role, and practice) and keep your login credentials confidential. You are responsible for activity carried out under your account. Tell us promptly if you suspect unauthorised access.
4. Acceptable use
You agree to:
- Use the service only for lawful, legitimate practice quality-improvement purposes
- Never enter patient-identifiable or special-category data anywhere in the service
- Verify AI-generated suggestions before acting on them, and route clinical decisions through appropriate clinical judgement
- Not attempt to disrupt, scrape at scale, reverse-engineer, or interfere with the service or its underlying data
- Not share your account, or access data for a practice you are not authorised to view
4a. Licences, usage allowances and fair use
Paid access is sold as a practice licence. One licence is granted to a single GP practice, identified by its ODS code, and runs for 12 months from the date we activate it. The fee is calculated from the practice’s registered list size at the date the invoice is raised, at the per-patient rate then current, subject to the minimum and maximum annual amounts shown on your quote and invoice.
A practice licence includes up to 20 named user accounts at that practice. Accounts are personal and must not be shared (see §4). If your practice needs more than 20 accounts, contact us and we will agree an extended allowance and any additional fee before those accounts are enabled.
Other elements of the service carry their own fair-use allowances, because they cost us money for each use. In particular, AI-generated plans are subject to a monthly limit shared across all users at your practice, and to overall daily limits across the service as a whole. Current allowances are shown in the product where they apply.
Allowances may change. We may vary the user allowance, the fair-use limits, the per-patient rate and the minimum and maximum annual amounts, for example where our own costs change, an allowance is being used in a way it was not designed for, or we judge a change necessary to keep the service sustainable. Changes will not alter the price of a licence you have already paid for during its current 12-month term. Allowance changes may apply to your practice at any time, including during a paid term, and we will tell you before they take effect. We may apply a temporary reduction at any time where necessary to protect the stability or security of the service, or where use is clearly automated, excessive or abusive.
Fees are payable in advance by bank transfer. Access begins once payment is received and processed, within 7 working days. Except where the law requires otherwise, fees already paid are non-refundable, and we do not refund part of a term if your list size falls or you use the service less than expected.
5. Prohibited use
You must not use Datim-QI to make an individual patient’s clinical decision, for legal or employment advice, for safeguarding or whistleblowing matters, or in an emergency or urgent-care situation. Aggregate findings and AI drafts must be checked through your organisation’s normal clinical and quality governance before action.
6. Availability of the service
We may modify, suspend or discontinue the service, in whole or part, at any time, including for maintenance, data-source changes, or third-party (AI provider, hosting, database) outages. We are not responsible for access issues outside our control.
7. Intellectual property
The Datim-QI name, branding, website and underlying software are owned by Datim-QI Ltd. You may use AI-generated plans and messages for your own practice’s quality-improvement work, but you are responsible for verifying their accuracy before use, and must not resell or commercially redistribute the service’s output or underlying software without permission.
8. Limitation of liability
To the fullest extent permitted by law, Datim-QI Ltd is not liable for errors or inaccuracies in AI-generated content, decisions made in reliance on the service, losses arising from use of the service, or regulatory or professional consequences of misuse. Nothing in these Terms excludes liability that cannot lawfully be excluded.
9. Third-party services
Datim-QI relies on third-party providers for account/database services, AI processing and hosting; see §6 of the Privacy Policy for the current list. We are not responsible for the availability or policies of these providers.
10. Your data rights
Your UK GDPR rights are described in the Privacy Policy. To make a request, email hello@datim-qi.uk.
11. Termination
You may stop using the service and request account deletion at any time. We may suspend or terminate access if you breach these Terms, misuse the service, or where required by law.
12. Governing law
These Terms are governed by the law of England and Wales. Disputes will be handled exclusively by the courts of England and Wales.
13. Changes to these terms
We may update these Terms from time to time. The current version is always available on this page. Continued use of Datim-QI means you accept any updates.
